Terms of Service

1About these terms

These Terms of Service (the “Terms”) are an agreement between you and pod (“pod”, “we”, “us”). They apply when you create a pod account, and whenever you use the website at usepod.fun, its API, or any other interface we provide (together, the “Interface”).

You accept the Terms by signing up for a pod account, or by using the Interface. If you don’t agree to them, don’t create an account or use the Interface.

Some features rely on other companies’ services, which have their own terms. Section 15 covers them.

2Who can use pod

You can use pod only if all of the following are true:

  • you are at least 18 years old and can enter into a binding contract;
  • you are not a person or entity targeted by sanctions administered by the United Kingdom, the European Union, the United Nations or the United States, and you are not owned or controlled by one;
  • you are not located in, ordinarily resident in, or organised under the laws of a country or region subject to comprehensive sanctions, or any place we tell you in the Interface that pod is not available;
  • using pod is lawful for you where you are. It is your responsibility to check this; and
  • we have not previously suspended or closed your account.

If you use pod for a business or other organisation, you confirm that you are authorised to accept these Terms on its behalf, and “you” includes that organisation.

3pod is an unaudited preview

pod is in private preview. Today it runs only on Solana devnet, a test network. Tokens, basket shares and SOL on devnet have no monetary value, and nothing you do there involves real funds.

The on-chain programs pod uses have not been independently audited. Features may be incomplete, change without notice, or stop working. We may reset preview data, rename or remove features, or end the preview at any time.

If pod launches on Solana mainnet, transactions will involve assets with real value and the risks in Section 12 become real financial risks. We will update these Terms before that happens (Section 23).

4Your account

You sign in to pod through an email address or a Google, X or Apple account, using an authentication service provided by Privy. You then choose a username (or use your X profile) and a trading wallet.

  • Keep the information you give us accurate, and keep your sign-in methods secure. Anyone who controls your email, Google, X or Apple account may be able to sign in to pod as you.
  • One account per person. Don’t create accounts to get around a restriction, or to collect referral rewards from yourself.
  • Usernames must not impersonate anyone, infringe anyone’s rights, or be offensive. We may reclaim or change a username that breaks these Terms.
  • X handles take priority over chosen usernames. If you choose a username that matches someone’s X handle and they later sign up with that X account, they may take the name. Your account is then given a different username, and your referral link keeps working.

Tell us promptly if you think someone else has accessed your account. You are responsible for activity on your account, except where it results from our failure to take reasonable care.

5Wallets and signing

pod is a non-custodial interface: we do not hold your assets. Your assets sit in a wallet you control. You choose one of two kinds when you sign up.

Your own wallet

If you link a wallet such as Phantom, Solflare or Backpack, you sign one free message to prove you own it. After that, every transaction is shown in your wallet and you sign it yourself. We never have your private keys.

A pod wallet

A pod wallet is an embedded Solana wallet provided by Privy and unlocked by your pod sign-in. When you create one, you authorise pod to add a limited signer to it, so that trades you request in the Interface can be signed by our server without a wallet pop-up. That signer:

  • signs only transactions that pod’s own API has built in response to your request, and only within a short time of building them;
  • is restricted by a policy enforced by Privy to the programs pod uses (pod’s programs, the Solana system and token programs, and the trading venues pod routes through); and
  • is never used to withdraw or export your funds. Withdrawals and key exports are always done by you, in your browser.

You can export your pod wallet’s private key and use it elsewhere. If you lose access to the sign-in method that unlocks your pod wallet, we may not be able to help you recover it. Privy’s terms also apply to embedded wallets.

Transactions are final

Solana transactions cannot be reversed once confirmed. Check the details of every transaction before you sign or confirm it, including amounts, slippage, the token’s address and the network. We cannot cancel, reverse or refund a transaction, and we cannot recover assets sent to the wrong address.

6What pod is, and isn’t

pod is software. The Interface helps you read public blockchain data and prepare transactions for permissionless programs on Solana: bonding-curve markets, basket vaults and “Deep” liquidity pools. Those programs run on the blockchain, not on our servers, and anyone can interact with them directly.

We are not your broker, exchange, custodian, financial adviser, fiduciary or agent. We do not create, issue, sponsor, endorse or vet the tokens or baskets that people launch through pod, and listing something in the Interface is not a recommendation. Prices, market caps, charts, valuations and previews are estimates drawn from on-chain and third-party data, and may be delayed or wrong.

7Launching tokens and creating baskets

Anyone with an account can launch a token or propose a basket. If you do, you are its creator and you are responsible for it. You agree that:

  • what you launch, and how you describe and promote it, will comply with the law that applies to you and to the people you promote it to, including securities, financial-promotion, consumer-protection and advertising law;
  • you will not present a token as an investment with expected profits, a share in a business, or a promise of returns, and you will not make false or misleading claims about it;
  • you own, or have permission to use, the name, ticker, image, links and description you submit, and none of them infringe anyone’s rights, impersonate anyone or imply an endorsement that doesn’t exist; and
  • you will not launch tokens designed to defraud, manipulate or mislead (for example “rug pulls”, honeypots or copies of other projects).

Some things are permanent. A token’s supply, metadata and buy/sell tax cannot be changed after launch, and its mint and freeze authorities are revoked. Images and metadata are pinned to IPFS and referenced on-chain, so we cannot delete them from the blockchain or from IPFS, although we can stop showing them in the Interface. A basket’s assets and target weights are fixed when it is created.

Creator fee routing is chosen at launch. A community takeover, where available, can change where a token’s creator fee stream goes.

8Trading, liquidity and baskets

  • Bonding curves. New tokens trade on a bonding curve: each buy raises the price and each sell lowers it. At a set threshold (measured in SOL equivalent) a token graduates and keeps trading in a Deep pool whose liquidity tokens are burned.
  • Previews are estimates. Quotes can change before your transaction lands. Your slippage setting is the most the price may move against you; a trade that would exceed it fails, and you may still pay network fees.
  • Routing. Some trades route through third-party venues and aggregators (for example Jupiter and Raydium). Those venues are outside our control.
  • Baskets. A basket share is a proportional claim on whatever a basket vault holds at the moment you redeem. It is not a claim to a fixed value or to the basket’s target weights, and the vault’s contents can drift as prices move and people deposit and redeem.
  • Liquidity. If you add liquidity to a pool, you may suffer impermanent loss, and liquidity that isn’t locked can be withdrawn by whoever provided it. Check a pool’s lock status before relying on it.

9Fees and referral rewards

Launching a token, graduating and opening a pool carry no pod fee. You pay Solana network fees and account rent, which go to the network, not to us.

Trades on bonding curves and graduated pools pay a trade fee that falls from 1.00% at or below a $10,000 market cap to 0.05% at or above $100 million. It is split between pod and the token creator’s chosen route, and, where a token launched on someone else’s community basket, the basket’s creator. In a pool opened by hand, most of the fee goes to its liquidity providers. Any buy/sell tax a creator sets goes to the token’s holders, not to us. The current split is described on How it works, and the fees for each trade are shown before you confirm it.

Fees are enforced by the on-chain programs, and the split for a market is fixed when it launches. We may change fees for future launches or new features, and will show the new fees in the Interface first.

Referral rewards

When someone signs up through your referral link, you earn a share (currently 10%) of the trading fees they pay, funded from pod’s share. Rewards accrue on finalized trades and are claimed through your dashboard. You may not refer yourself, use multiple accounts, pay or mislead people to sign up, or spam your link. We may withhold or reverse rewards earned in breach of these Terms, and we may change or end the referral programme for future activity at any time. Rewards you have already validly earned stay claimable.

10Profiles, endorsements and your content

Your username, profile picture, bio, any linked X profile, your wallet address and your activity can be seen by other people, both in the Interface and on the public blockchain. Endorsements you post on a token are public and show your holding.

You keep ownership of what you submit, such as images, names, descriptions and endorsements (“Your Content”). You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example resize) and distribute Your Content to run, show and promote pod. Because some of Your Content is stored on IPFS and the blockchain, this licence continues for as long as that content remains there.

We may remove, hide or label any content in the Interface, or any token or basket from its listings, at our discretion, including content we believe is unlawful, misleading, infringing or harmful. We have no obligation to monitor content, and hiding something from the Interface does not remove it from the blockchain.

11Things you must not do

You must not use pod, or help anyone else use pod, to:

  • break any law, or evade sanctions, tax, anti-money-laundering or counter-terrorist-financing rules;
  • manipulate a market, including wash trading, spoofing, pump-and-dump schemes, or coordinated buying and selling to mislead others;
  • commit fraud, phishing or impersonation, or deceive other users;
  • infringe anyone’s intellectual property, privacy or other rights;
  • post content that is illegal, sexually exploits children, promotes violence or hatred, or harasses anyone;
  • probe, scan, overload or attack the Interface, our API or our infrastructure, get around rate limits or access controls, or exploit a bug (report it to us instead); or
  • scrape the Interface or use bots in a way that harms it or its users, except through any public API we provide and within its limits.

12Risks you accept

Using pod involves significant risk. You acknowledge and accept that:

  • You can lose everything you put in. Tokens launched on pod are highly speculative, often have no use or backing, and can go to zero quickly.
  • Prices are volatile and liquidity can be thin, so you may not be able to sell, or only at a much lower price.
  • Smart contracts can contain bugs or be exploited, and pod’s programs have not been audited.
  • Basket shares carry the risks of every asset in the basket, including issuer, custody and depeg risks for tokenized stocks, stablecoins and other wrapped assets.
  • Solana, its validators, RPC providers, Privy, price sources and the venues pod routes through can fail, be congested, or be changed or attacked, and transactions can fail or be front-run.
  • Token creators, other traders and liquidity providers may act against your interests.
  • Laws and regulation of crypto-assets are changing and may restrict or end your ability to use pod, or affect the value of what you hold.
  • Anyone who gets access to your sign-in, wallet or private key can take your assets.

Only use assets you can afford to lose entirely.

13No advice

Nothing in the Interface, our posts or our communications is financial, investment, legal or tax advice, or a recommendation to buy, sell or hold anything. You are solely responsible for deciding whether a transaction is right for you. Get independent professional advice if you need it.

14Taxes

You are responsible for working out, reporting and paying any tax that applies to your activity on pod, including on trades, fees, creator income, holder distributions and referral rewards. We don’t withhold tax or give tax reports unless the law requires us to.

15Third-party services

pod depends on services we don’t control, including Privy (sign-in and embedded wallets), Google, X and Apple (sign-in), the Solana network and RPC providers, IPFS pinning services, wallet apps, price feeds, and trading venues such as Jupiter and Raydium. Your use of them is governed by their own terms and privacy policies. We are not responsible for them, their availability, or what they do with your information, and a link to a third-party site is not an endorsement.

16Our intellectual property

The Interface, including its design, text, graphics, the pod name and logo, and our software (other than code we publish under an open-source licence, which that licence governs), belongs to us or our licensors. We give you a personal, revocable, non-transferable, non-exclusive licence to use the Interface as these Terms allow. You may not copy, modify, sell or create derivative works of it, or use our name or logo, without our written permission.

If you send us feedback or ideas, we may use them freely without paying you or crediting you.

17Your information

To run your account we process: the email address or Google, X or Apple identity you sign in with (through Privy); your username, profile picture and bio; your wallet address and wallet type; who referred you; session details such as your browser’s user agent; server logs, which include IP addresses; and a record of which version of these Terms you accepted and when.

We use this to provide and secure pod, pay referral rewards, prevent abuse, meet legal obligations and improve the product. We share it only with the service providers that help us run pod (for example authentication, hosting and storage providers), when the law requires us to, or as part of a sale or reorganisation of our business. Information that is on the blockchain or IPFS is public and permanent, and cannot be deleted by us.

Depending on where you live, you may have rights over your personal data, such as the right to access, correct or delete it, or to object to how we use it. Contact us (Section 26) to use them. You can also complain to your data protection authority; in the UK that is the Information Commissioner’s Office.

18Suspension and closing your account

We may suspend or close your account, restrict access to the Interface, or refuse a transaction we would otherwise prepare, if we reasonably believe you have broken these Terms or the law, if we must do so to comply with law, a court or a regulator, to protect pod or its users, or if we stop offering pod or a feature of it. Where it is lawful and practical we will tell you why.

You can stop using pod at any time and ask us to close your account. Closing an account doesn’t affect your wallet or anything on the blockchain; you keep full control of your own wallet, and should export a pod wallet’s key or move your assets out first.

Sections 5 (transactions are final), 7, 10, 12 to 14, 16, and 20 to 25 continue after your account closes.

19Changes to pod

We are building pod in the open and it will change. We may add, change or remove features, change supported assets, networks or venues, or stop the Interface, temporarily or permanently. We will try to give notice of significant changes, but we don’t promise that the Interface or any feature will always be available.

20Disclaimers

To the fullest extent the law allows, pod is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or uninterrupted, secure or error-free operation. Some of these exclusions may not apply to you if you are a consumer; Section 21 explains which rights you keep.

21Limits on our liability

To the fullest extent the law allows, we are not liable for: losses caused by the blockchain, smart contracts, third-party services, other users or token creators; the value of any token or basket, or price movements; transactions you signed or requested; losses from someone accessing your sign-in, wallet or keys; or any loss of profits, revenue, data, opportunity or goodwill, or indirect or consequential loss.

Otherwise, our total liability to you for all claims arising out of or relating to pod or these Terms is limited to the greater of £100 and the total fees you paid to pod in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded. If you are a consumer, nothing in these Terms affects your statutory rights.

22Your responsibility to us

If you are using pod for business purposes, you agree to compensate us for reasonable losses, costs and expenses (including reasonable legal fees) arising from claims by third parties that result from your breach of these Terms, your violation of law or of someone else’s rights, or a token, basket or content you created. If you are a consumer, you are responsible for losses you cause us by breaking these Terms, as the law provides.

23Changes to these Terms

We may update these Terms. Each version has a date, shown at the top of this page, and we keep a record of which version you accepted. If we make a material change, we will tell you in the Interface before it takes effect and may ask you to accept the new version before you continue using your account. If you don’t agree to a change, stop using pod and close your account. Changes don’t apply to disputes that arose before they took effect.

24Governing law and disputes

These Terms, and any dispute about them or about pod, are governed by the law of England and Wales. Please contact us first; most problems can be solved informally.

The courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the United Kingdom or the European Union, you may also bring proceedings in the courts where you live, and you keep the benefit of any mandatory consumer protections of that country’s law.

25General

  • These Terms are the whole agreement between you and us about pod, and replace any earlier understanding.
  • If a court finds part of these Terms unenforceable, the rest stays in effect.
  • If we don’t enforce a right straight away, we can still enforce it later.
  • You may not transfer your rights under these Terms. We may transfer ours to another organisation as part of a reorganisation or sale of our business, and will tell you if we do.
  • No one else has rights under these Terms, except where they say so.
  • We are not responsible for delays or failures caused by events outside our reasonable control.
  • Headings and the summary at the top of this page are for convenience; they don’t change the meaning of the Terms.
